View Full Version : Advice for moving violation defense

So this musclehead cop decides to give me a ticket for running a red light. It was totally made up on his part as the light was green all the way. It must've been quota time and he had to pad his numbers. Cops can say whatever they want and make stuff up out of the clear blue.

So give me your best defenses to get out of this ticket! What should I say and do?

(It could cost me $125 if I lose for something I didn't do)

Hmmmm....tough one for you...

I don't know if there is much you can do. Nolo would be a waste.

Its your word against the cops.

Pleading to the judge for a reduced fine may be your only hope.

Well I heard one person who contested the ticket, and because the officer was not there, walked out for free. In some states, they may not have such laws but in Louisiana they have a strike two plan or something that if you plead not guilty, your on like a probation or something for 2 years, and if you keep your nose clean (tickets or accidents) then your record is kept clean. But if you get nabbed, both show up on your record, no questions

I go through this intersection everyday from work, for the past 20 years. I don't know how many times I get up there, and some nut job is running the light, and no cops are around, but sure enough, nabbed me. I paid the ticket and told the cop I was cancelling my annual police ball subscription. I asked him what number do I need to call to cancel my state trooper one also? This only works when the cop is about to write your ticket. You can always say, "Thanks officer, I'll just call my friend at the precint and have him remove this anyway, take care".

As an ex Cop I can give you these words of advise.

1. Contest it! The DA has better things to do than prosecute things like this. You will probably be offered a non moving violation to plead and get off for $25 unless its a first offence in 5 years then they usually drop it.

2. Show up with a lawyer. Except for DWI or other major offences the DA will toss it 99% of the time.

3. Be honest but nice. Do not be abusive about the cop or make subjective statements about law enforcement.

In Georgia....nolo is no contest for people with no previous convictions as it is used for. It is up to the judge as to whther to be accepted or not.

I didnt know that this is exclusive to Georgia and no longer used.

It's a plea you can use once that says you are neither guilty or not guilty....if that makes any sense. Nolo is short for a latin phrase nolo contendere used in the legal system. By using nolo you can get a reduced fine. It's used in borderline cases.

Someone may be able to better explain it than me...

Not just that, accumulate points and your insurance also goes up. Ask Sarcastic1, he's an officer of the law. He might be able to give some advice.
But you made out better then me. In traffic yesterday I hit the rear of some car. Only like 15mph but my nissan 240 is low and slid underneath her bumper and it took out my hedder panel, lights, bumber, and hood. My fenders were spared. Luckily all cosmetic. But when the cop ask me what happened, I said. 'well, theres traffic, she stopped, I didn't and I bumped her'. Seeing I had no intention of making excuses or anything the cop written on the accident report 'Inattentive driving' and did not give me a summons. So now my car has got to go in the shop.
First time I've made any kind of claim in 25 years of driving. Several times in the past it was always someone else hitting me. Now you watch if my insurance doesn't sky rocket over a lousy $5,000 damage between the two cars. I can smell the insurance company trying to reap me already.

3. Ask for deferred judification. Usually only works with a lawyer present. Meaning you promise to be a good boy for a year.
4. Ask to have your court date changed. Hope the cop will not show and your off.

Suggest the first and get it over with, least of amount of hastle and your free time is not wasted.

I like #4. What's a good excuse to have the court date changed? And when should I ask this and how? It has to be before the date they give me so I just call the court?

Calling Sgt. Pepper!

I used that excuse and it worked and they postponed my court date until early February.

What are the chances of postponing it a 2nd time?

And what would a good 2nd excuse be?
