October 3, 2003 - David Lee Roth has dropped his lawsuit against Van Halen! This link to the case summary at the Los Angeles Superior Court reveals that a request for the case to be dismissed was filed by Roth's attorney on September 24, 2003.

Roth filed the lawsuit against his former bandmates on December 11, 2002 [VHND article]. He claimed that Eddie, Alex and Michael signed a new royalty deal with Warner Bros. in 1996 without his permission and without telling him. He claimed to be out of pocket by $200,000 to the end of 2001. At the time it was reported that Roth demanded a full audit of all royalties earned by Van Halen since he left the band in 1985.

Roth recently cancelled the remaining dates of his current tour after a mishap on stage in Philadelphia on September 17. According to reports, Diamond Dave was doing a kung fu manoever during Jump when the bar he uses cut him just above his eye. The cut required 21 stiches.

Hmm. he dropped his lawsuit against VH..could it be that he is a member now???? Hmm...

CLARIFICATION OF DAVID LEE ROTH/VAN HALEN LAWSUIT:
A long time regular to the site happened to catch the news item about David Lee Roth dropping suit against Van Halen "without prejudice" and kindly e-mails in an explanation of that term.
Jim writes: "From a loyal site visitor for many years who happens to be a lawyer, I thought I would lend some help with the term "without prejudice". When a lawsuit is dropped without prejudice, this means that DLR has dropped the suit (for now), but has not forfeited the right to re-institute the law suit at a later date. This is often a procedural move due to defects in the legal papers filed. In other words, DLR is saying that he is dropping the suit now, but he retains the right to re-institute the suit at a later date. If there WAS a settlement, the case would have been dropped with prejudice which would not allow DLR to file the suit again! Thought this might help."
Indeed it does Jim, thanks! So, no deal has been done, nor has the suit been settled. But it definitely has been dropped for now.
